In Re: Upper Crust LLC"Mosquito Creek"75881 Hwy 21 ) ORDERCozad NE 69130Retail Class IB-60724 Liquor LicenseNow on the 29th day of November, 2007, this matter came on for hearing before the Nebraska Liquor Control Commission upon an order to show cause why the license should not be suspended, cancelled or revoked for failure to file a new manager's application within sixty (60) days as required by 237-LCC2-009 of the Rules and Regulations of the Nebraska Liquor Control Commission.
Additionally, State Patrol Investigator has concerns regarding Rex Kotschwar, a convicted felon, having involvement with the business. In addition to his conviction there is an issue of character and reputation surrounding the businesses practices.
In accordance with the Commission's policies, a proper notice of this hearing was sent by U.S. Certified Mail, return receipt requested. The licensee was not present nor represented. The Commission was represented by Milissa Johnson-Wiles, Assistant Attorney General.
Upon consideration of all the evidence in this case, the Nebraska Liquor Control Commission finds:
1. That the licensee has failed to file a new manager' s application as required by 237-LCC2-009 of the Rules and Regulations of the Nebraska Liquor Control Commission.
2. A hidden ownership interest exists.
3.That the license should be revoked. IT IS THEREFORE CONSIDERED, ORDERED, ADJUDGED AND DECREED that the Class I B license of Upper Crust LLC, dba "Mosquito Creek", 75881Hwy 21, Cozad, Nebraska, should be, and the same hereby is, revoked, effective at the closing hour of business on the 20th day of January, 2008.
IT IS FURTHER ORDERED that the licensee shall pay costs of this action,assessed in the amount of $23.00.

What Ever Happened To: Shakers Strip Club

Despite protests from neighbors, a nude strip club moved into Cozad last year.
Shakers juice bar opened on Highway 21, south of the interstate, in March 2008. Dan Robinson, the owner, runs a similar operation in Waverly.
Dawson County commissioners didn't have any legal ground to stand on to keep it out of Cozad because several businesses had already set up shop in that same building, before the county established its zoning and planning regulations. The property was grandfathered in as a nonconforming use. Also, because Shakers wasn't selling alcohol, it couldn't be regulated through a liquor license.
Russ Parsons bought his home and was in the process of remodeling it when he found out Shakers was going to be his next door neighbor.
Russ Parsons, a Cozad resident, said, "I do have a couple of young daughters and I didn't really want them spending the night and that going on."
So, he stopped working on the house and decided not to move in.
"Shakers moving in would have made our property values lower and the house wouldn't have
been worth what I was putting into it," he explained.
Althea Hill, who lives on the other side of the property, felt the same way.
"It was too close and we were afraid of the noise and stuff," said Hill.
Their fears were short lived. Shakers moved out after only six months.
Hill commented, "The only time that we saw very much traffic out there was the first night and most of that was people coming out to see who else was there."
NTV News contacted Robinson who said business was good.
The former owner of Upper Crust Pizza, Rex Kotschwar. leased the property and Robinson paid him rent. Robinson said when he found out Kotschwar was way behind in taxes he backed out. NTV News was unable to contact Kotschwar, but a former county commissioner confirms Robinson's claim and also said there was a lien on the property.
"Just all of a sudden why there was just nothing or nobody. And, so, we didn't know what had happened there for quite awhile," said Hill.
While Shakers is gone, there's no stopping another strip club from moving in.
Kurt McBride, the deputy attorney for Dawson County, said, "Dawson County has not made any changes to zoning that would specifically address the area of adult entertainment businesses. One of the reasons they have not is because of constitutional restrictions that would impact a business like that. That would probably open the county up to lawsuit."
Russ is taking his chances and plans to finally move in before winter. His neighbor now is a bait shop and auction house.
"I was surprised they even tried to open it up in Cozad. But, I was pretty happy when they moved out," he said.
Shakers auctioned off items when it left.
Robinson still runs a similar operation in Waverly.

Genesis International was founded in 1998 and has launched its health and shelter programs throughout the world in order to combat infectious disease and inadequate shelter for those in need. By placing health care centers at the heart of the problem areas Genesis feels a great difference can be made and we can stop the spread of these infectious diseases. We also feel the need to connect the youth of the world with the adults in every community. With the social and economic problems as well as natural disasters escalating throughout the United States and around the world, we are currently focusing our time and resources at home, here in the United States as well as certain other "Hot Spots" in the world. This is the future that will be the cement which strengthens the communities and the youth.
Programs
Genesis International Foundation's programs include building health care centers in areas of infectious disease epidemics, staff training, supply of required medicines and disease screening programs throughout the world. Our shelter program targets communities suffering from economic, conflict and natural related disasters by providing housing, shelter and sanitation facilities throughout the world with a heavy emphasis here in the United States. Genesis International has been building health care facilities overseas for the last 4 years. We have negotiated with local civic health officials for permission to locate small health clinics in the local slums. Permissions have been granted and the program is waiting for funding. The connection between shelter, health and sanitation is becoming more apparent every day.

The GIF addresses control of infectious disease epidemics by placing primary health clinics directly at the source of the epidemics. GIF is also capable of providing shelter to those in need. Accomplishments for Fiscal Year Ending December 31, 2007
1. Genesis International has established several primary health care facilities in Southeast Asia with a focus on HIV, TB, & related infectious diseases.
2. Genesis is providing shelter and sanitation in slum communities in developing countries in an effort to raise the health standard of the area.
3. We are addressing the need for shelter in the earthquake devastated area of western India, where one million people are homeless. We are providing a low-cost, immediate use shelter as well as materials for rebuilding lives.
Objectives for Fiscal Year Beginning January 1, 2008
1. To provide 250 primary health care facilities located in the infectious disease epicenters in select developing countries to combat the spread of the top 6 infectious diseases (HIV, TB, malaria, pneumonia, measles & diarrhea).
2. Provide buildings for homes and shelters, building technology and sanitary facilities to at least 20 communities around the world with a focus on the United States and the devastation caused from the current natural and economic disasters.
3. To meet even more of the need that natural disasters continue to create affecting the worlds poor population.

Nude bar- Defeated, Dawson Co. board looks to keep it out

LEXINGTON — Dawson County can’t stop a juice bar that will have nude dancers from opening south of Cozad, but it will try to stop any similar place from opening.
The Dawson County Board of Commissioners passed a resolution Friday directing the county’s planning and zoning commission to review portions of the regulations that deal with nonconforming businesses.
Planning and Zoning Administrator Ellen Arms said a review of the regulations that would prohibit a non-alcohol striptease business will begin when the commission meets Monday.
“We take this very seriously,” Arms said Friday.
Dan Robinson of Lincoln plans to open Shaker’s West at 75881 Highway 21, south of the Interstate 80 interchange south of Cozad, next week. Robinson has a similar operation near Waverly. Because the business won’t sell alcohol, it can’t be regulated through a liquor license.
Commissioner Linda Benjamin said the basis by which the juice bar will go into business has attracted statewide interest from planners and lawyers who have universally said there is nothing the county can do.
“We’ve heard what we can’t do, but we haven’t heard what we can do in the future,” Benjamin said. She said a county can’t pass ordinances, but it can exercise control through its zoning regulations.
The juice bar is able to open because it is going into a location that was open as a business before the county established its zoning and planning regulations and thus was grandfathered as a nonconforming use.
The grandfathering would be broken if use is discontinued for 12 consecutive months, but the previous business’s closing and the opening of Shakers falls within the permitted time frame.
Rex Kotschwar, a former Cozad resident, previously operated a café and pizza business known as Upper Crust at the location.
The business started as a bait shop many years ago without obtaining a special-use permit. Over time, the business was expanded to include a café with liquor sales and the pizza business. The pizza business closed on July 31.
“I’ve met with Mr. Robinson. I didn’t welcome him to Dawson County. I asked him, ‘Why?’” Benjamin said Friday.
Robinson, she said, picked the location when he learned that the property was grandfathered.
